This Master Terms of Service Agreement ("Agreement") governs all services ("Services") provided by Anchor Installs-RED ("Provider") to any enrolled Member ("Member"). Provider is a membership-only service. No Services will be performed for non-members.
Article 1 – Definitions
Provider means Anchor Installs-RED, a division of Anchor Installs, LLC, including employees, subcontractors, vendors, and authorized representatives.
Member means any individual or business enrolled in a RED membership plan for commercial or business purposes.
Services include installation and removal of signage, mandatory storage and handling, movement tracking, scheduling, inventory management, custom artwork and fabrication, sign repair, FLIR ground-penetration scans, and coordination of 811 Dig Tests when applicable.
Credits: A Credit equals one complete service action (one installation and its eventual removal, or one pickup/removal of a sign installed by another provider). Additional Credits: $49 per Credit. Credits have no cash value, do not roll over, and expire at the end of each billing cycle.
Article 3 – Membership Requirements
Membership is mandatory for all Services. Member must maintain accurate contact information, a valid payment method, and an appropriate membership tier.
Article 8 – Billing & Membership Terms
6-Month Commitment Plan: Lower monthly rate. Early termination may result in charges up to the remaining term.
Month-to-Month Plan: Higher monthly rate, can be cancelled prior to the next billing date.
Membership fees are automatically charged on the monthly anniversary date. Provider may adjust fees with notice.
Article 9 – Storage Rules
- Steady Plan (2 Credits): up to 4 signs stored
- Base Plan (4 Credits): up to 8 signs stored
- Scale Plan (9 Credits): up to 18 signs stored
- Prime Plan (15 Credits): up to 30 signs stored
Provider is not responsible for theft, vandalism, weather damage, or deterioration of signs.
Article 15 – Limitation of Liability
Provider's total liability shall not exceed the amount paid for the specific Service giving rise to the claim. Provider is not liable for lost commissions, lost business opportunities, or indirect damages.
Article 16 – Indemnification
Member agrees to indemnify and hold Provider harmless from claims arising from Member's instructions, unsafe site conditions, property access disputes, or violations of regulations.
Article 19 – Termination
Month-to-Month Members may cancel prior to the next billing date. 6-Month Commitment Members may be charged remaining term amounts for early termination. Upon termination, all Credits are forfeited.
Article 20 – Arbitration
Disputes shall be resolved by binding arbitration in Tarrant County, Texas, before a single arbitrator.
Article 21 – Class Action Waiver
Member agrees to bring any dispute solely in Member's individual capacity, not as part of a class action.
Article 22 – Jury Trial Waiver
Both parties waive any right to a trial by jury.
